1. SPONSOR

The Flylow Monthly Gear Giveaway (the “Sweepstakes”) is sponsored by Flylow Sports, LLC, doing business as Flylow Gear, 1132 S Bannock Street, Denver, Colorado 80223 (the “Sponsor”).

2. ELIGIBILITY

The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Void in Puerto Rico, all U.S. territories and possessions, and where prohibited or restricted by law.

Employees, officers, directors, members, agents, and representatives of Sponsor, and of its parent, subsidiary, affiliated, and related companies, advertising and promotion agencies, and the immediate family members (spouse, parents, siblings, children) and household members of each are not eligible to enter or win.

By entering, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes.

3. SWEEPSTAKES PERIOD

The Sweepstakes is an ongoing promotion conducted in consecutive monthly entry periods. Each monthly entry period begins at 12:00:01 a.m. Mountain Time on the first (1st) day of a calendar month and ends at 11:59:59 p.m. Mountain Time on the last day of that calendar month (each, an “Entry Period”). The first Entry Period begins on [START DATE]. Sponsor’s computer is the official time-keeping device for the Sweepstakes.

Drafting note: confirm the start date and whether you want the program to have a stated end date or to run “until terminated by Sponsor.” Both are common; choose one and remove this note before publishing.

4. HOW TO ENTER

Online Entry. During the Entry Period, visit flylowgear.com and submit a complete entry form via the on-site giveaway pop-up by providing the requested information, including a valid email address. Limit one (1) entry per person and per email address per Entry Period. Multiple entries received from the same person or email address in a single Entry Period will be void.

Free Method of Entry (AMOE). To enter without providing an email address or visiting the website, hand-print your full name, complete mailing address, daytime telephone number, date of birth, and the words “Flylow Monthly Gear Giveaway” on a 3” x 5” card and mail it in a #10 envelope with sufficient postage to: Flylow Monthly Gear Giveaway, Flylow Sports, LLC, 1132 S Bannock Street, Denver, CO 80223. Mail-in entries must be postmarked within the Entry Period and received within seven (7) days after the end of that Entry Period to be eligible for that month’s drawing. Limit one (1) mail-in entry per person and per household per Entry Period. Mechanically reproduced entries are not eligible.

All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, late, misdirected, garbled, incomplete, illegible, postage-due, or undeliverable entries, or for any technical malfunctions, human error, or any other cause that may limit or prevent any person’s ability to participate.

5. DRAWING AND WINNER SELECTION

Within fourteen (14) days following the close of each Entry Period, Sponsor will select one (1) potential winner per Entry Period in a random drawing from among all eligible entries received for that Entry Period. The odds of winning depend on the number of eligible entries received for that Entry Period.

6. PRIZE

One (1) prize will be awarded per Entry Period, consisting of Flylow Gear product(s) selected by Sponsor. The Approximate Retail Value (“ARV”) of each monthly prize will not exceed Two Hundred Fifty U.S. Dollars ($250.00 USD). The specific item(s) awarded are at Sponsor’s sole discretion and will be based on available inventory and the winner’s stated shopping preference where reasonably possible.

Prizes are non-transferable, non-assignable, and may not be substituted, exchanged, or redeemed for cash, except by Sponsor, which reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. No more than the stated number of prizes will be awarded.

7. WINNER NOTIFICATION

Each potential winner will be notified by email at the address provided at entry (or by mail for AMOE entrants). The potential winner must respond to the notification within seven (7) calendar days of the date the notification is sent. Failure to respond within the response period, return of any notification as undeliverable, failure to comply with these Official Rules, or inability to verify eligibility may result in disqualification and selection of an alternate winner from among the remaining eligible entries.

As a condition of receiving the prize, a potential winner may be required to sign and return an Affidavit of Eligibility, a Liability Release, and (where lawful) a Publicity Release within seven (7) calendar days of the date such documents are sent. If a potential winner fails to return any required document within the specified time, the prize will be forfeited and an alternate winner may be selected.

8. TAXES

All federal, state, and local taxes, and any other costs and expenses associated with prize acceptance and use not specified herein as being provided, are the sole responsibility of the winner. Winners may be required to provide Sponsor with a valid taxpayer identification number (e.g., Social Security Number) before the prize will be awarded if required by applicable tax reporting rules.

9. PUBLICITY

Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsor’s use of the winner’s name, voice, likeness, photograph, biographical information, statements about the Sweepstakes or Sponsor, and city and state of residence for promotional purposes in any media, worldwide, in perpetuity, without further payment, notice, review, approval, or consideration.

10. RELEASE AND LIMITATION OF LIABILITY

By entering, each entrant agrees to release, discharge, and hold harmless Sponsor and its parent, subsidiary, affiliated, and related companies, and each of their respective officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) of any kind arising out of or in connection with participation in the Sweepstakes or the acceptance, possession, use, or misuse of any prize.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.

If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes and select winners from among all eligible, non-suspect entries received prior to action taken.

11. DISPUTES AND GOVERNING LAW

Except where prohibited, by participating in the Sweepstakes each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Denver County, Colorado; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event shall include attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules.

12. PRIVACY

Information collected from entrants is subject to Sponsor’s Privacy Policy, available at flylowgear.com. By entering, you consent to the collection, use, and disclosure of your personal information by Sponsor as described in the Privacy Policy and in these Official Rules.

13. WINNERS LIST AND RULES REQUESTS

For a copy of these Official Rules or a list of winners (available after the close of each applicable Entry Period), send a self-addressed, stamped envelope to: Flylow Monthly Gear Giveaway — Rules/Winners Request, Flylow Sports, LLC, 1132 S Bannock Street, Denver, CO 80223. Specify “Rules” or “Winners List” and the applicable Entry Period(s).

14. GENERAL

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., Instagram, X (formerly Twitter), TikTok, Google, Apple, Klaviyo, Shopify, or any other social media or service provider platform. Entrants release any such platform from any and all liability arising out of participation in this Sweepstakes.

If any provision of these Official Rules is held to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.
